A lawsuit filed against Packers Sanitation Services claims the company failed to compensate the plaintiff at her proper time-and-a-half overtime rate.

A lawsuit filed against Packers Sanitation Services, Inc., LTD claims the company failed to compensate the plaintiff at her proper time-and-a-half overtime rate.
The proposed class and collective action was filed out of Arkansas federal court by a “sanitation laborer” employed by the company. The plaintiff alleges that she regularly worked in excess of 40 hours per week and was compensated with an hourly rate of pay, as well as “non-discretionary money awards and bonuses on a regular basis when certain objective and measurable criteria were met.” The lawsuit claims that although the plaintiff received time-and-a-half overtime wages, the rate was calculated based on her hourly rate, “exclusive of the non-discretionary bonus.” As such, the suit alleges that the plaintiff did not receive the full amount of overtime wages owed, as bonuses “must be totaled in with other earnings” in the calculation of overtime pay rates under the Fair Labor Standards Act and state law.
