Pablo's Machine Shop & Welding Corp and one individual owner are facing a lawsuit filed by a former employee seeking to recover allegedly unpaid overtime wages.
A proposed collective action has been filed against Pablo’s Machine Shop & Welding Corp and one individual owner over claims that the defendants deprived a former employee of time-and-a-half overtime wages.
According to the complaint, the plaintiff worked an average of 62.5 hours each week at the Florida-based shop from November 2017 to July 2018 without proper overtime pay. The man worked an irregular schedule in which his workday concluded upon finishing the day’s assignment, the suit says. The complaint claims the defendant paid the plaintiff $10 per hour in company checks and failed to issue proper paystubs indicating the number of hours worked or the plaintiff’s rate of pay. The case alleges the plaintiff “was compensated for all hours worked at his regular rate,” and estimates the man is owed $3,937.50 in unpaid wages.
