The owning and operating entities of four Essen restaurant locations in New York City are the defendants in a proposed class action filed by seven former employees who claim they are owed unpaid minimum and overtime wages. The case alleges defendants BNP NY Foods, Inc., Amici 519 LLC, 100 Broad Street LLC, Ten Westside Corp., and their owners violated the Fair Labor Standards Act (FLSA) by failing to pay proposed class members time-and-a-half overtime wages, state-required spread-of-hours pay, and minimum wages. Additionally, the defendants allegedly only paid the named plaintiffs in cash and required them to sign a document for which they were not allowed to view the contents of in order to get paid each week.
