New York
Two former employees have filed suit against a company and individual who operate Osaka Japanese Restaurant claiming the parties failed to comply with federal and state wage and hour laws. The plaintiffs allege they both worked for the defendants as food preparers, dishwashers, and cooks for at least 10 years and were paid a weekly salary that increased throughout their employment. The suit argues, however, that their salaries did not include premium overtime wages they should have received for all the hours they worked above 40 each week and spread-of-hours wages for each shift that lasted longer than 10 hours.
The plaintiffs say they worked between 62.5 and 75 hours per week and were never given accurate wage statements reflecting their hours and pay rates.
