Two plaintiffs have filed a collective action in Virginia against BDR Hospitality, LLC and its title manager in which they claim they’re owed unpaid overtime.
Two named plaintiffs have filed a proposed collective action in Virginia against BDR Hospitality, LLC and its title manager in which they claim they’re owed unpaid overtime.
The lawsuit says the plaintiffs worked at the defendants’ Millennium Hotel Durham from June through about August 2016 performing carpentry, cleaning and flooring work alongside 45 to 50 others. According to the complaint, the plaintiffs put in more than 60 hours per week without being paid time-and-a-half overtime for every hour worked in excess of 40. BDR Hospitality classified the plaintiffs as independent contractors despite having substantial oversight over “the essential terms and conditions of the employment” of members of the proposed collective, the suit says.
