Three entities and an individual who operate Leoni’s Pizzeria locations in Florida are the defendants in a proposed collective action filed by a former employee who claims he was not paid proper overtime wages. According to the complaint, the plaintiff worked for defendants BA Pizza Inc., BA Pizza II, Inc. and BA Pizza III, Inc. at the companies’ North Naples location from September 2015 through February 2018 delivering food, assembling take-out orders and cleaning the restaurant. The man claims that although he worked more than 40 hours in most, if not all, workweeks for his regular hourly rate, the defendants failed to pay him for every hour worked past this threshold at a time-and-a-half hourly rate.
