Five former employees of On Time Moving System, Inc. have filed a proposed collective action against the moving company and an individual owner alleging they are owed unpaid overtime wages.
Five former employees of On Time Moving System, Inc. have filed a proposed collective action against the moving company and an individual owner alleging they are owed unpaid overtime wages. The plaintiffs were hourly paid employees, according to the complaint, and were scheduled to work 65 hours per week for the defendants. They claim they were always paid at their straight-time rate – varying from $7 to $15 per hour – instead of receiving time-and-a-half wages for the hours they worked above 40 each week, an alleged violation of the Fair Labor Standards Act.
