A wage and hour lawsuit filed in August 2018 against the operators of two Olive Garden restaurants has been removed to federal court in California.

The individual behind the proposed class action was employed at the defendants’ Manhattan Beach and Huntington Beach locations, according to the complaint. The case alleges the defendants violated state labor laws by failing to provide workers with uninterrupted meal and rest periods, resulting in unpaid wages when employees were required to work through breaks. Additionally, the suit charges the plaintiff was deprived of an additional hour of pay for each workday in which breaks were not provided, another potential violation of California law.
The suit goes on to allege the plaintiff and similarly situated employees were deprived of minimum and overtime wages stemming from off-the-clock work and the defendants’ allegedly inaccurate time-keeping practices.
Moreover, the woman claims she wasn’t issued wages in a timely manner, didn’t receive accurate paystubs, and was not reimbursed for business expenses, including work-related cell phone use.
