Nassau County, New York, its police department, and the Nassau County Civil Service Commission are the defendants in a proposed class action filed by ambulance medical technicians (AMTs) who claim they are owed overtime wages for hours worked in excess of 36 in a workweek. The lawsuit, filed on behalf of Nassau County AMTs and AMT supervisors and coordinators, claims proposed class members regularly worked 48-hour weeks (the benchmark for OT pay for certain emergency workers is 36 hours per week) without being paid time-and-a-half overtime wages. Specifically, the lawsuit argues the paychecks of AMTs allegedly reflect that they are working 80 hours over a two-week pay period when they only work 72 hours, resulting in the incorrect calculation of overtime hours worked and a lower overtime pay rate.
