Hyo Dong Gak, Inc. and Hanbat Restaurant, Inc. are among the defendants in a lawsuit filed by two plaintiffs who claim they’re owed unpaid minimum and overtime wages.
Hyo Dong Gak, Inc. and Hanbat Restaurant, Inc. are among the defendants in a lawsuit filed by two plaintiffs who claim they’re owed unpaid minimum and overtime wages. According to the complaint, one plaintiff worked at the neighboring New York City restaurants as a food preparer and delivery employee from 2004 through March 2018, while the other split time between the eateries performing the same tasks between April 2014 and March 2018. Both plaintiffs received fixed weekly wages in cash regardless of the number of hours worked, with each man required to sign a “false document” stating he worked fewer hours than were actually put in to receive his pay, the case claims.
“[The defendants] knowingly and willfully operated their business with a policy of not paying either the [Fair Labor Standards Act] minimum wage or the New York State minimum wage to the [plaintiffs] and other similarly situated employees,” the lawsuit alleges.
The complaint adds that the plaintiffs were allegedly paid an improper, reduced tip-credited rate in that they were required to spend more than 20 percent of their time each workday performing non-tipped tasks.
