New York City restaurant The Draft House and its three individual owners are facing a proposed collective action filed by a former employee who alleges he was deprived of proper wages.
According to the case, the plaintiff worked as a delivery driver and dishwasher at the eatery from October 2016 to September 2018, during which time he worked between 47 and 59 hours each week. The man alleges he was paid at an hourly rate for his first 40 hours of work. He then received a wage below his straight-time pay rate for only some of his overtime, the case says, causing his regular pay rate to fall below the required minimum wage.
The suit goes on to accuse the defendants of depriving the plaintiff of spread-of-hours wages, as well as failing to issue accurate paystubs and a wage notice. In addition, the case charges the defendants improperly deducted one to one-and-a-half hours of pay from the plaintiff’s weekly wages.
