Mountain Farms, Inc., the operating entity behind the Delmonico gourmet deli in New York City, and two individuals with control over the eatery face a proposed collective action filed over allegedly unpaid wages.
Mountain Farms, Inc., the operating entity behind the Delmonico gourmet deli in New York City, and two individuals with control over the eatery face a proposed collective action filed over allegedly unpaid wages. The two named plaintiffs allege they worked upward of 40 hours per week without being paid proper minimum or overtime wages or spread-of-hours pay for days in which they worked 10-hour-plus shifts.
One plaintiff worked for the defendants from November 2012 until March 2018, the lawsuit says, while the other worked at Delmonico from June 2015 through March 2018. The plaintiffs respectively claim they typically worked 55 and between 62.5 and 67.5 hours per week without proper wages. According to the complaint, neither man was required to keep track of his time while employed at Delmonico.
In addition to the alleged wage and hour violations, the defendants reportedly required the plaintiffs to sign documents they were not allowed to review in detail in order for their flat weekly pay to be released.
