D&J Real Estate Management II LLC, 3171 Rochambeau Ave. LLC, Bronx Boynton Ave. LLC, and an individual owner are facing claims that they failed to pay their employees proper wages and provide them with required wage documents. The three named plaintiffs, two building superintendents and one porter, claim they worked for the defendants’ property management business beginning in the summer of 2012 and averaged more than 40 hours of work per week without receiving overtime wages. Starting in 2014, the defendants allegedly began requiring employees to fill out timesheets, which the suit claims is a result of another wage and hour lawsuit filed against the companies, but the plaintiffs argue that they were instructed to never record more than 40 hours per week, regardless of how many hours they actually worked.
The porter plaintiff additionally attests that his pay fell below both the federal and the New York minimum wage. On top of that, the suit alleges that he and other employees were unlawfully denied accurate wage statements and notices.
