Construction company NY NJ Restoration Inc. and three individuals who run the business are the defendants in a proposed collective action filed by five plaintiffs who claim they and other workers are owed unpaid overtime and spread-of-hours wages. Filed in New York, the lawsuit claims the plaintiffs, who all ended their employment with the defendants in June 2017, not only worked well in excess of 40 hours per week—one plaintiff says during a certain timeframe he worked 112 hours per week—but also were never granted meal or rest break of any length throughout their workdays. The construction workers, the case notes, were also allegedly forced to pay for their own “tools of the trade,” such as a drill, masks and boots, without reimbursement.
