SSC Carmichael Operating Company LP, SavaSeniorCare, LLC and six of their affiliates have been named in a proposed class action filed by one current and two former employees who claim they were denied proper wages, meal and rest breaks, and wage statements in accordance with state and federal labor laws.
The plaintiffs – two certified nursing assistants and a licensed practical nurse – say they were paid an hourly rate to work at the defendants’ residential care and rehabilitation facilities. According to the complaint, they only received premium time-and-a-half overtime wages when they worked more than eight hours in a day or 80 hours in a two-week period, but were not always paid proper overtime when they worked more than 40 hours in a week.
On top of that, the case alleges, the defendants automatically deducted 30-minute meal periods from employees’ hours regardless of whether they actually took uninterrupted breaks. As a result, the plaintiffs and others did not receive mandated minimum wages for all their hours, the case says.
The complaint claims the defendants’ alleged pay violations also caused inaccuracies in employees’ wage statements in violation of California labor law.
