A proposed collective action has been filed against Venice HMA, LLC by two former employees who claim they were denied overtime wages while working at the hospital as nurse case managers. The defendant, which operates as Venice Regional Bayfront Health, allegedly altered employees’ time records to reflect that they only worked 40 hours per week despite requiring them to work overtime. The plaintiffs say 30-minute lunch breaks were automatically deducted from their hours regardless of whether they were able to take breaks and were told that they had to clock out at the end of their scheduled shifts even if they stayed beyond this time.
One of the plaintiffs also alleges individual claims of retaliation and unjust imprisonment. The suit describes an occasion on which the plaintiff witnessed a fellow nurse case manager enter an isolation room “without the appropriate personal protective equipment.” She further argues that the same coworker and another nurse case manager falsified medical records by filling out patient information without interviewing the patients and recording other employees’ names on their entries. On top of that, the plaintiff says the first nurse case manager entered her cubicle and “yelled at [the plaintiff]” while blocking her exit. She allegedly reported these illegal acts to the defendant’s Human Resources department but claims no action was taken. Instead, the plaintiff claims she was terminated in retaliation for her complaints.
