A former 26-year employee claims the companies' policy of automatically deducting a one-hour daily break from workers' pay led to the underpayment of OT.
A New York man formerly employed as a mail room worker by Novitex Enterprise Solutions and its successor in interest The Millennium Group of Delaware has filed a proposed class action against the courier management companies seeking to recover allegedly unpaid overtime wages. The plaintiff, who the case says worked for the defendants from June 1991 through November 2017, details in the lawsuit the companies’ alleged policy of automatically deducting one hour of pay per day from employees’ weekly wages for lunch breaks. The man claims that due to the demands of the job, he worked through his lunch break during most work days, while during others he spent only between 15 to 20 minutes eating lunch. On rare occasions, the case continues, the plaintiff was able to take a lunch break of 30 minutes or more.
According to the lawsuit, the defendants’ mandatory one-hour lunch deduction resulted in the underpayment of weekly overtime wages. The plaintiff claims he worked between 50 and 60 hours per week without being paid proper time-and-a-half overtime.
