Martinez v. G5IVE, LLC et al
Filed: July 28, 2017 ◆§ 1:17-cv-22857-CMA
A woman's proposed class action against Miami club G5IVE claims she and other adult entertainers are owed unpaid minimum and overtime wages.
A woman formerly employed as an adult entertainer by North Miami Beach club G5IVE has filed a proposed collective action against the company and its owner to recover allegedly unpaid wages. Citing possible Fair Labor Standards Act (FLSA) abuses, the lawsuit claims the plaintiff and similarly situated individuals were never paid minimum or overtime wages, forced to share tips with non-tipped employees, and required to pay house fees for the right to work at the defendants’ club.
The complaint alleges the defendants’ FLSA-violating practices caused proposed collective members’ wages to be reduced to nothing, with the workers’ income coming solely from a share of tips from patrons.
