North Carolina Quarry Workers Sue Over Alleged Off-the-Clock Work, Unpaid OT

Two employees have filed suit against Carolina Quarries and Rock of Ages Corporation in which they claim they did not receive proper wages.

Two employees have filed a proposed class action against Carolina Quarries, Inc. and Rock of Ages Corporation in which they claim they were not paid for all time worked and deprived of time-and-a-half overtime wages.
The suit says the plaintiffs were employed by the natural stone manufacturers as quarry workers based out of North Carolina. The plaintiffs allege they were regularly required to come into work a half-hour early, time that was not reflected in their paystubs despite supposedly being on the clock. The individuals also claim they received straight-time pay for overtime work and were granted no paid rest breaks despite their “physically demanding and potentially hazardous work conditions.”
Further, the defendants supposedly directed the employees to punch out when traveling between local work locations, a policy the suit says was put in place “with the intent of avoiding culpability in the event that an accident occurred while in transit.” The workers were also deprived of pay for hours spent driving to distant worksites, some of which were as far as New Hampshire, the case claims.
The complaint goes on to note that one of the plaintiffs approached an HR representative and a manager about being underpaid, to which he was allegedly told the manager would “look into it and get back to him” but never did.
