A former employee of No Pressure Roof Cleaning LLC has filed suit against the company and an individual with control of the business claiming they misclassified him as an independent contractor and failed to pay him proper overtime wages.
A former employee of No Pressure Roof Cleaning LLC has filed suit against the company and an individual with control of the business claiming they misclassified him as an independent contractor and failed to pay him proper overtime wages. The plaintiff says he was employed as a spray technician and was responsible for performing manual labor and non-exempt job duties such as pressure cleaning roofs and picking up supplies from the store in the company truck. According to the complaint, the defendants should have classified him as an employee based on the level of control they maintained over his hours, rate of pay, and job duties. He claims he is owed at least $3,500 of unpaid overtime wages.
The suit further argues that the defendants unlawfully failed to pay required taxes to the government on behalf of employees and neglected to keep track of hours worked.
