The operators of Nisi Estiatorio on Bleecker St. in New York City are the defendants in a lawsuit filed by a former employee looking to recover allegedly unpaid wages.
Filed against Paali Enterprises Inc. and an individual with control over the restaurant, the lawsuit says the plaintiff worked roughly 57.5 hours per week for the defendants between July 2017 and March 2018 without being paid time-and-a-half overtime. The case claims the plaintiff was paid a fixed monthly salary of $1,000 in check and cash without regard to his number of hours worked per week.
“[The defendants] knowingly and willfully operated their business with a policy of not paying either the [Fair Labor Standards Act] overtime rate (of time and one-half) or the New York State overtime rate (of time and one-half) to the Plaintiff and other similarly situated employees,” according to the suit.
