Drivers, EMTs and paramedics claim in a lawsuit that Vital Care EMS failed to pay proper time-and-a-half overtime wages.
Nine plaintiffs have put their names on a proposed class action in which they allege Vital Care EMS, Inc. denied overtime wages in violation of the Fair Labor Standards Act (FLSA) and the South Carolina Payment of Wages Act. The plaintiffs—employed by the private medical transport service as drivers, emergency medical technicians or paramedics with the last three years—allege they regularly worked more than 40 hours per week without being paid time-and-a-half hourly overtime. The lawsuit charges the plaintiffs’ pay was incorrect as a result of the defendant:
