Three former employees of Thai Num Soup Inc. (which does business as Thai Soup) have filed suit against the company and an individual owner over claims that the defendants violated the Fair Labor Standards Act and New York state law.
Three former employees of Thai Num Soup Inc. (which does business as Thai Soup) have filed suit against the company and an individual owner over claims that the defendants violated the Fair Labor Standards Act and New York state law. The plaintiffs – who were employed as delivery workers and a food preparer – regularly worked more than 40 hours per week without receiving proper overtime and spread-of-hours wages, according to the complaint. They argue that the defendants failed to maintain any timekeeping device and neglected to accurately record and compensate them for their actual hours worked. The suit further alleges that the delivery workers were not reimbursed for the “tools of the trade,” including bicycles, locks, and helmets.
