Gong Hey Fat Choi, LLC is facing a proposed collective action alleging violations of the Fair Labor Standards Act (FLSA).
Gong Hey Fat Choi, LLC – a New York-based company that does business as Cata Restaurant – and two individual owners/managers are the defendants in a proposed collective action alleging violations of the Fair Labor Standards Act (FLSA). The plaintiff is a former employee who says he worked as a server for the defendants for six months, with his employment ending in October 2015. He alleges that the defendants paid him the tipped minimum wage without appropriately notifying him that a tip credit was being applied to his pay. The plaintiff seeks compensation for the defendants’ allegedly “willful and unlawful conduct” in failing to pay him at the proper minimum wage rate.
