Bistro Marketplace 17 Inc. (which does business as Café Bistro) and two individuals with control of the business are facing a lawsuit filed by two former employees who claim they were not paid proper wages or provided with required wage documents.

Bistro Marketplace 17 Inc. (which does business as Café Bistro) and two individuals with control of the business are facing a proposed collective action filed by two former employees who claim they were not paid proper wages or provided with required wage documents in accordance with federal and state labor laws. The plaintiffs say they were employed as an assistant sushi preparer and a salad preparer, respectively, and that they often worked more than 40 hours per week without receiving overtime wages. Additionally, the complaint alleges that the plaintiffs were not paid spread-of-hours wages when they worked shifts lasting longer than 10 hours at a time.
The suit further argues that the defendants failed to keep track of employees’ hours and never provided them with required wage statements detailing their hours and rates of pay.
