The owners and operators of Signature Footcare and Austin 26 Dental Group have been accused by a former employee of violating provisions of state and federal labor laws. The man claims he worked for the healthcare centers as a flyer distributor and was paid $7.50 per hour for approximately 42.5 hours of work per week. He argues that the defendants failed to fulfill their obligation to maintain accurate time records and didn’t pay him for all his hours worked, including for an approximately three-week period at the end of April 2016 for which he was allegedly paid no wages at all. On top of that, the plaintiff claims he should have received time-and-a-half premium pay for the hours he worked over 40 each week, pursuant to the Fair Labor Standards Act’s overtime requirements.
The suit further argues that the defendants denied employees proper wage notices and statements in accordance with state law. Moreover, the defendants allegedly failed to reimburse the plaintiff for purchasing gloves, shoes, socks, jackets, and body warmers – “tools of the trade” he says were required to perform his job duties.
