Filed: July 16, 2018 ◆§ 1:18cv4072
A former New York Fast Carting Corp. truck driver claims he worked between 60 and 72 hours per week without being paid proper overtime wages.
New York
New York Fast General Contracting Corp., which operates as New York Fast Carting Corp., and two individuals are the defendants in a proposed collective action in which the plaintiff claims he’s owed unpaid overtime wages.
According to the complaint, the plaintiff worked as a truck driver for the defendants from March 2016 through early July 2018. Throughout his employment, the plaintiff consistently put in between 60 and 72 hours of work per week without being paid time-and-a-half overtime for every hour worked in excess of 40, the suit claims. Instead, the plaintiff was allegedly paid a fixed salary of $300 per day that did not vary depending on his number of hours worked per week. Moreover, the plaintiff alleges he was never provided meal or break periods of any kind throughout his employment.
