A proposed collective action out of New York federal court claims that New Ram’s Deli Plus failed to pay employees proper wages.
The lawsuit, which names the Bronx deli’s two operating companies and three individual owners as defendants, was filed by two former workers who allege they regularly worked well over 40 hours each week without appropriate compensation. The complaint says the plaintiffs were usually paid fixed salaries that did not vary based on the number of hours worked, resulting in pay rates that fell below the minimum hourly threshold. Further, the suit claims the workers were never paid time-and-a-half overtime wages nor granted any breaks, not to mention spread-of-hours pay for shifts that lasted over 10 hours as mandated by New York law.
The case goes on to charge that the defendants failed to issue the plaintiffs proper wage notices, as well as accurate wage statements, throughout their respective employment periods. In addition, the suit says the plaintiffs were not reimbursed for out-of-pocket business expenses, such as construction paper purchased for the deli.
