A former employee of New Hama Fusion has filed suit against the restaurant’s operating company and three individuals with control of the business over claims that they failed to adhere to state and federal labor laws. The plaintiff alleges he was employed as a fry wok between April and November 2016 and was not paid time-and-a-half overtime wages despite working 59.5 hours per week. He claims the defendants paid him a flat rate of $600 (and later $650) per week regardless of whether he worked additional hours beyond his usual schedule, meaning he was not paid for some of the time he spent working.
Moreover, the suit argues that the defendants failed to pay their employees spread-of-hours pay and never provided them with accurate wage statements and notices.
