Neovia Logistics Hit with Class Action Over Alleged Time Shaving, Unpaid Wages

A lawsuit takes issue with Neovia Logistics' alleged policy of failing to pay wages for all hours worked, particularly for interrupted meal breaks.

A proposed wage and hour class action filed in mid-February against Neovia Logistics Distribution, LP and Neovia Logistics Services, LLC has been removed to California federal court.
The plaintiff alleges the defendants have a “continuous and widespread policy” of not paying non-exempt hourly employees for all hours worked, including for tasks done before and after scheduled shift start and end times. At the heart of the case is the defendants’ alleged practice of clocking out employees for 30-minute meal periods even though the individuals would continuously work through such periods, the suit says.
“The conduct complained of is a form of what is sometimes called ‘dinging,’ ‘shaving,’ or ‘scrubbing’ and is prohibited by law,” the complaint charges.
Moreover, the defendants allegedly require hourly employees to work at least five continuous hours without a meal period, while failing to pay the workers one hour of pay at their regular rate for each workday during which a meal period is not provided. The case makes similar claims with regard to 10-minute rest periods and alleges the defendants failed to provide compensation owed in lieu of the required breaks.
Rounding out the lawsuit are claims that the defendants fail to timely pay all owed wages upon an employee’s termination and provide accurate wage statements.
