National Facilities Maintenance LLC, Sani-Environmental Services Corp., and two individuals who operate the companies are facing a proposed collective action alleging violations of state and federal labor laws.
National Facilities Maintenance LLC, Sani-Environmental Services Corp., and two individuals who operate the companies are facing a proposed collective action alleging violations of state and federal labor laws. The plaintiff in the case, a former employee, claims he worked for the defendants cleaning garbage chutes and rooftops between October 2017 and March 2018. Though the man worked more than 40 hours per week and 10 hours per day, he was paid at his straight-time rate of $11.00 per hour for all hours worked, according to the complaint. The lawsuit argues that the plaintiff should have been paid time-and-a-half premium wages for his overtime hours and for the hours he worked over 10 each day.
Furthermore, the case claims the defendants didn’t pay the man any wages for his last three week of employment and never provided him with accurate wage statements and notices in accordance with New York state law.
