The company that runs Muzzarella Pizza in New York City allegedly failed to pay mandatory minimum, overtime and spread-of-hours wages to employees.
Muzzarella Inc., which operates Muzzarella Pizza in New York City, and two owners are staring down a proposed collective action filed by a former employee who claims he and others were not paid proper overtime wages. In addition to allegedly unpaid time-and-a-half overtime, the plaintiff, who wore the hats of food preparer, counter attendant, pizza maker and delivery worker during his employment, claims he was never paid New York state-required spread-of-hours wages owed for shifts that lasted longer than 10 hours in a day.
According to the complaint, the plaintiff worked for the defendants from 2003 through early August 2017. For a span between 2011 and 2015, the plaintiff says he typically worked 61.5 hours per week without proper wages. From roughly June 2015 until May 2017, the case continues, the plaintiff worked approximately 10 fewer hours per week, but still without proper pay. Moreover, the plaintiff claims he was never reimbursed for spending his own money on “tools of the trade,” including three bicycles.
