A former delivery driver for MLK Express Services and Amazon has filed a lawsuit in which she claims the companies failed to pay her proper overtime wages.

A former delivery driver for MLK Express Services LLC and Amazon.com Services, Inc. has filed a proposed collective action in which she claims the companies failed to pay her proper overtime wages.
According to the complaint, MLK Express operates a carrier and logistics business that provides trucks and drivers to its client companies, which include Amazon. The plaintiff says she worked as a non-exempt driver for the companies at an Amazon-operated facility in Fort Myers, Florida from August 2017 to April 2018. The woman claims that during her tenure she put in at least 12 hours each shift—totaling over 60 hours of work each week—for a flat daily rate that did not include proper time-and-a-half overtime compensation.
“Sometimes Plaintiff would receive $1 per package when she was required to deliver packages to assist other drivers after completing her own route. However, this additional $1 per package did not come close to compensating her for all hours over 40 at the required overtime rate,” the case adds.
The suit alleges the defendants “acted with reckless disregard” for the Fair Labor Standards Act (FLSA) when they deprived the plaintiff and similarly situated employees of their lawful wages.
