EOG Resources and Bedrock Petroleum Consultants face a lawsuit in which the plaintiff claims he put in between 12 and 20 hours per day without proper wages.

A proposed collective and class action filed in September 2017 against EOG Resources, Inc., Bedrock Petroleum Consultants, LLC and one individual has been removed from New Mexico federal court to the Southern District of Texas. The plaintiff worked as a consultant for the defendants for five months in 2017, during which time he claims he was misclassified as an independent contractor. According to the complaint, the plaintiff put in between 12 and 20 hours per day, and sometimes worked up to 35 days straight, for a day rate that did not vary depending on the number of hours worked.
The complaint points out that the relationship between the defendants and the plaintiff resembled that of an employer-employee relationship. Specifically, the suit claims that the plaintiff was subject to schedules set by the defendants and had no freedom to choose work assignments. The lawsuit asserts the defendants misclassified the plaintiff and similarly situated consultants as independent contractors as a means to avoid paying taxes, benefits, and overtime wages.
