Lorenzo v. Mike's Mastercraft Collision Center, Inc. et al
Filed: March 2, 2018 ◆§ 1:18cv1341
Mike’s Mastercraft Collision Center, Inc. and two individual owners are the defendants in a proposed collective action filed by a former employee who claims he wasn’t paid properly.
New York
Mike’s Mastercraft Collision Center, Inc. and two individual owners are the defendants in a proposed collective action filed by a former employee who claims he wasn’t paid properly. The man says he worked at the defendant’s auto body shop as a detailer and technician, frequently putting in between 45 and 50 hours of work per week without being paid premium time-and-a-half wages for the hours he worked over 40.
The suit further claims the defendants made unlawful deductions from the plaintiff’s wages, including subtracting time for lunch breaks he never took and withholding “two to three hours of his weekly pay” if he reported to work a few minutes late. The man claims he purchased “tools of the trade” – such as a ratchet, sockets, screwdrivers, drills, and a toolbox – without being reimbursed.
Moreover, the defendants allegedly violated state law by neglecting to post notices regarding employees’ wage rights and failing to provide accurate wage statements.
