Midway Food Market Facing Lawsuit Over Claims of Unpaid Wages, Retaliatory Discharge

A former cashier for Midway Food Market has sued the business for allegedly unpaid overtime wages.
Midway Food Market and one individual with control of the Miami business have been named as defendants in a lawsuit filed by a former cashier who says he did not receive proper overtime wages or pay for all hours worked.
The plaintiff regularly clocked between 70 and 84 hours each week for an hourly rate of $10, the suit says. The case alleges that the defendant “intentionally refused” to pay the man time-and-a-half wages for overtime work and owes the plaintiff more than $29,000 in unpaid wages.
Further, the plaintiff charges that the defendants withheld his final paychecks after he voiced his concerns about the company’s pay practices.
“As a result of the non-payment of wages to Plaintiff, he has been forced to quit,” the complaint reads. “The Defendants have constructively discharged Plaintiff.”
