A proposed collective action has been filed against Mid Atlantic Professionals, Inc. over the company’s allegedly improper pay practices. According to the suit, the defendant provides to the U.S. Army training services that include sending role players to various military bases for participation in pre-deployment exercises. The plaintiffs in the case claim they were employed as role players and paid a flat daily fee – usually $300.00 – plus per diem rates.
For each mission, the case alleges, the plaintiffs and proposed class members were told to meet at a specific location where they were then transported to one of the bases, ranging from 11 to 20 hours away. The plaintiffs say each mission lasted between nine and 13 days, with each day many times totaling 14 hours of work. The suit claims employees were not paid for their travel time and were not provided with time-and-a-half premium wages for any hours they worked above 40 each week. In fact, the complaint alleges, employees were instructed to record only eight hours per shift on their timesheets – an amount that was “substantially lower” than their actual hours worked.
