MIchael's Family Restaurant, Inc. and its execs allegedly failed to pay servers overtime wages while maintaining an illegal tip pool, a lawsuit claims.

Michael’s Family Restaurant, Inc., the operator of 12 eateries in the greater Philadelphia area, and three individuals with control over the business are facing a proposed collective and class action from two servers who allege they’re subject to company-wide wage and hour violations of the Fair Labor Standards Act (FLSA). In addition to allegedly owing servers unpaid time-and-a-half overtime wages for hours worked past 40 each week, the defendants also supposedly maintain a mandatory tip pool from which they, rather than use the money to tip bussers, “take possession of the pooled tips and use these funds to pay the wages of other employees, namely bussers,” the case reads.
The plaintiffs make a point to claim the defendants impose a “strict company-wide policy against logging overtime hours” on their timeclock.
