The operators of Bodega Taqueria Y Tequila face a lawsuit from a plaintiff who claims he worked an average of 85 hours per week without proper overtime.

A proposed class action has been filed in Florida against 1220 Management Group, LLC, which operates as Miami Beach eatery Bodega Taqueria Y Tequila; TC Hospitality Management LLC; and three individuals with control of the companies over alleged wage and hour violations of the Fair Labor Standards Act (FLSA). The plaintiff claims he worked an average of 85 hours per week for $12 per hour between December 2013 and December 2017 without ever being paid time-and-a-half hourly overtime wages. The lawsuit asserts the defendants “willfully and intentionally” refused to pay proper overtime for any hours worked over 40 each week.
