McKenzie Floral Facing Unpaid Overtime Lawsuit in New York

Bohemia, New York flower shop McKenzie Floral Inc. and an individual with oversight of the business face a proposed collective action filed by two named plaintiffs who allege they were not paid proper minimum or overtime wages for any hours worked.
According to the lawsuit, one plaintiff worked for the defendants from September 2012 through June 2018, while the other worked for McKenzie Floral from January 2013 through mid-June 2018. One plaintiff says he typically worked 50 to 60 hours per week but put in anywhere from 108.5 to 119 hours during weeks in which a holiday or special event took place. The second named plaintiff claims she regularly put in 66 to 84 hours each week and between 77 and 105 for holiday- and special-event weeks without time-and-a-half overtime compensation.
The case states the plaintiffs’ pay never varied when they were required to work later than their scheduled shift end times. Further still, the plaintiffs claim they were never provided wage statements documenting their actual hours worked.
