Last Updated on May 8, 2018
Fuentes v. Maxim Healthcare Services, Inc.
Filed: October 24, 2017 ◆§ 3:17-cv-02178-CAB-NLS
Allegedly unpaid overtime is the subject of a proposed class action filed in California against Maxim Healthcare Services, Inc.
A California woman claims in a proposed class action that defendant Maxim Healthcare Service, Inc. failed to pay current and former hourly employees proper overtime wages. The lawsuit claims that the plaintiff in December of 2016 and January 2017 was given a nondiscretionary bonus of $76 from the defendant that the company did not take into account when calculating her time-and-a-half overtime pay rate. Further, the plaintiff charges that within the last four years, Maxim Healthcare Service has, on a few dozen occasions, issued inaccurate wage and earning statements to proposed class members with regard to their overtime compensation.
