Matiz Latin Cuisine and the restaurant’s two owners are facing a former employee’s proposed collective action in which the man claims he was deprived of lawful overtime wages.
The plaintiff worked as a cook at the Forest Hill, New York eatery from November 2015 to February 2018, according to the suit. The man claims that he regularly worked 51 hours per week for an hourly rate of between $13 and $15. The suit alleges, however, the plaintiff did not receive time-and-a-half pay for his overtime hours. Moreover, the case claims the defendants violated New York law by not issuing the man a proper wage notice and failing to maintain proper payroll records.
