Pena Hernandez et al v. Jim Giles Corp. et al
Filed: March 1, 2018 ◆§ 1:18cv1874
Jim Giles Corp., which operates Central Bar in Manhattan, faces a lawsuit claiming it failed to pay proper minimum and overtime wages.
A proposed collective action has been filed against Jim Giles Corp., the operator of Central Bar in Manhattan, and its two owners over allegations that employees were not paid proper wages under the Fair Labor Standards Act (FLSA). The plaintiffs claim their pay never varied when they were required to stay later or work longer than their scheduled shift times. Each man further claims they were never granted meal or rest breaks of any kind during their tenures at Central Bar.
One plaintiff, whose time with the defendants ended in December 2018, claims he sometimes worked up to 60 hours per week without proper pay, with the defendants allegedly requiring him to start working three hours prior to his scheduled start time and continue working one or two hours past his set departure time. The other plaintiff’s situation was similar, the lawsuit continues, as the man claims he regularly worked around 50 hours per week for a fixed salary.
