Superruay Corp. and three individual owners have been named in a proposed collective action that alleges the defendants committed labor law violations.
Superruay Corp. and three individuals with control of the business have been named in a proposed collective action that alleges the defendants committed federal and state labor law violations. The defendants, who own and operate a Thai restaurant named Larb Ubol, are accused of failing to provide the plaintiffs, former employees of the defendants, with minimum, overtime, and spread of hours wages.
According to the lawsuit, the defendants compensated the plaintiffs with fixed weekly salaries in cash ranging from $530 to $900 per week that never changed based on the number of hours worked. As a result, the defendants failed to pay the plaintiffs and other employees the legally required minimum wage and overtime pay. For instance, the plaintiffs allege that from September 2014 and February 2018, respectively, until June 2018, they regularly worked in excess of 40 hours per week as cooks for the restaurant without proper time-and-a-half compensation.
