T.R.F.C. 932 Restaurant Enterprises, Ltd. and an individual with control of the business have been accused of violating federal and state labor laws. The plaintiffs, who were formerly employed respectively as a cook and a salad maker/dishwasher at the defendants’ restaurant, Matt’s Grill, say they regularly worked more than 40 hours per week without receiving proper overtime wages. One of the plaintiffs claims she was not provided with spread-of-hours wages for her over-10-hour shifts and notes that she was never reimbursed for purchasing shoes and three shirts required to perform her job. The other plaintiff says he was paid a fixed salary in cash regardless of whether he worked past the end of his scheduled shifts, meaning some of his hours went uncompensated.
On top of the unpaid wage allegations, the plaintiffs both insist they were deprived of meal and rest breaks and never received mandatory wage documents that detailed their rights and recorded their hours.
The suit seeks to cover a proposed class of employees who worked for the defendants during the past three years.
