Campos et al v. Midtown Auto Care Service Inc. et al
Filed: June 4, 2018 ◆§ 1:18cv4936
Two parking attendants claim they and other Manhattan parking garage workers haven't been paid proper overtime wages.
New York
Two parking attendants have filed suit against Midtown Auto Care Service Inc., S.T.A. Parking Corp., and two individual owners of the joint enterprise over claims that they have not been paid proper overtime wages. According to the lawsuit, the defendants operate two parking garages in Manhattan – on 45th Street and 76th Street, respectively – and require the plaintiffs to work at both locations throughout their employment. The men allege that despite putting in more than 40 hours—and sometimes up to 62 hours—of work per week, they were not provided with premium time-and-a-half overtime pay.
Moreover, the case argues that the plaintiffs were rarely provided with required wage statements and didn’t receive written notices detailing their employment rights. On the occasions when they did receive paystubs, the lawsuit attests, the statements only listed the portion of their wages paid by check and didn’t include cash payments.
