A former employee of Lucerne Bakery, Inc. has filed suit against the Miami eatery and an individual owner over allegations that the parties violated provisions of the Fair Labor Standards Act.
A former employee of Lucerne Bakery, Inc. has filed suit against the Miami eatery and an individual owner over allegations that the parties violated provisions of the Fair Labor Standards Act (FLSA). According to the complaint, the plaintiff was employed at the bakery as an attendant, cashier, and cleaning person between August 2014 and September 2017. She says she was paid $5.15 per hour plus customer tips, but was denied time-and-a-half overtime wages for the hours she worked above 40 each week.
The complaint argues that the defendants, “in order to circumvent FLSA regulation regarding the payment of overtime hours,” only recorded the plaintiff’s first 30 hours of weekly work and paid the rest of her hours separately in cash. As a result, the suit alleges, the defendants failed the FLSA’s recordkeeping and overtime requirements and owe the plaintiff approximately $3,770.34 in allegedly unpaid overtime wages.
The plaintiff further claims the defendants reduced her working hours “even more” when she returned to work after recovering from a broken leg and fired her a few months later for “discriminatory reasons.”
