A lawsuit claims Loving Heart Home Health Care failed to pay proper wages to the plaintiff, who claims she worked an average of 70 hours per week.
A proposed class action filed in Florida claims Loving Heart Home Health Care, Inc. and two individuals with control over the business failed to pay employees proper overtime. The plaintiff says she worked an average of 70 hours per week at the defendants’ assisted living facility from January 2015 through September 2016 without being paid time-and-a-half overtime wages. Further, the plaintiff says from September 2016 through November 2017, she worked an average of 70 hours per week but was never paid the extra half-time rate for seven of 30 overtime hours worked each week. The woman claims she was paid nothing at all for approximately 23 weekly overtime hours worked during this time period.
