A proposed collective action filed back in August claims Nassau County, NY's Wantagh Bagels failed to pay time-and-a-half overtime wages.
A proposed collective action filed in New York claims Nassau County eatery Wantagh Bagels and its owners violated the Fair Labor Standards Act (FLSA) by failing to pay proper time-and-a-half overtime wages. The plaintiff, who the case says worked as a baker for the defendants from May 2010 through July 2017, claims he worked roughly 56 hours per week between the beginning of his employment and December 2016 without being paid rightful time-and-a-half wages for all hours worked over 40. Further, the plaintiff alleges he’s owed unpaid spread-of-hours wages, which, under New York state law, are owed for shifts that last longer than 10 hours in a day. The case also alleges the defendants failed to provide the plaintiff with mandatory wage statements detailing his hourly rate of pay, number of regular hours worked, overtime pay rate, and number of overtime hours.
