Filed: March 22, 2018 ◆§ 1:18cv1776
The owners and operators of Little Sheep Mongolian Hot Pot are facing a proposed class and collective action filed by three former employees alleging violations of labor and civil rights laws.
New York
The owners and operators of Little Sheep Mongolian Hot Pot are facing a proposed class and collective action filed by three former employees alleging violations of labor and civil rights laws. The case claims the defendants failed to pay restaurant employees proper minimum and overtime wages, noting that each plaintiff worked for more than 40 – and sometimes over 60 – hours per week without receiving premium time-and-a-half pay.
The first plaintiff, a kitchen helper, says he was paid a fixed daily rate of $100.70, which was later increased to $120.83, for his approximately 52.5 hours of work per week.
The second plaintiff, also employed as a kitchen helper, claims the defendants gave her a weekly paycheck in the amount of $675.00 and also paid her an average of $650.00 per week in cash from the tip pool for working about 58 hours each week.
The last plaintiff was hired as a cook, according to the complaint, and was paid a fixed weekly salary of $1,125.00 for approximately 61.5 hours of work. He argues that the individual defendants frequently commented on his age and fired him after only a few weeks of employment solely for being older than the other employees.
In addition to the alleged wage violations, the case claims the defendants failed to provide employees with accurate paystubs and neglected to keep track of their hours – duties that they were obligated to perform under state labor law.
